HELENA – The governor says he will veto a key piece of Republican legislation that sets guidelines for carbon storage if it gets to his desk.
Senate Bill 498, introduced by Republican Sen. Keith Bales of Otter, is currently in a Senate committee. The bill defines how to regulate carbon storage, but does not clarify who owns the underground areas where carbon dioxide could be stored.
Democratic Gov. Brian Schweitzer says he will veto any carbon-storage bill that fails to define what is known as pore space. The governor supports Democratic House Bill 502, which gives pore space ownership to the state, with exceptions for natural gas reservoirs and some mineral estates. Republicans say a blanket definition of ownership would infringe on property rights.
